MeraNews Network, New Delhi: The Supreme Court on Monday dismissed a petition moved by Gujarat education minister Bhupendrasinh Chudasama seeking quashing of a petition filed by his opponent Ashwin Rathod challenging the victory of Chudasama from the Dholka constituency in the 2017 Gujarat Assembly Elections.

Last week Friday, the Gujarat High Court had dismissed Chudasama’s plea, after which the minister decided to move the apex court, but in vain. Ashwin Rathod of Congress had lost to Chudasama by a nominal margin in the assembly elections of Gujarat last December. He had challenged the win in Gujarat HC claiming that he was clearly winning the election as per the EVM votes, but there were gross misconduct and corruption in the counting of postal ballot votes as a part of a well-thought design by Chudasama to win, who went on to become the education minister of the state.

Chudasama, in his petition, claimed that the court cannot interfere in the matter of elections after the results have been declared by the Election Commission of India upon the counting of both EVM and postal ballot votes.

The Gujarat HC will hence conduct a hearing of the petition and the dispute will be adjudicated only after the trial.
